RESUMO

O presente trabalho tem como objetivo básico verificar se a cobrança pelo uso da água é possível, legítima, e se ela perfaz um instrumento eficiente para racionalização de seu uso. Para atingir tal objetivo pretende-se, primeiramente, delinear a realidade das águas mostrando a imprescindibilidade vital desse recurso e o estado de degradação em que se encontra, o que reflete, inclusive, em uma preocupação mundial quanto ao seu futuro. Em um segundo momento, busca-se traçar a evolução histórica legislativa a respeito da temática dos Recursos Hídricos, apresentando, ainda, as diretrizes da Política Nacional de Recursos Hídricos. Procura-se, ainda, tratar da abrangência da outorga dos usos da água, instrumento paralelo à cobrança. Por fim, vai-se dedicar à cobrança, procurando verificar a compatibilização do enquadramento jurídico dado a água como bem ambiental e como bem econômico.

ABSTRACT

The present work has the basic objective to verify if the charging for the use of water is possible, legitimate, and if it concerns an efficient instrument for rationalization of use. To reach such objective it is intended, firstly, to delineate the reality of the waters showing the vital imprescindibility of that resource and the degradation in that it shows, what contemplates, besides, in a world concern to the future. In a second moment, it is looked for to trace the legislative historical evolution regarding the thematic of the Water Resources, presenting, still, the guidelines of National Water Resource Management System. It is sought, still, to treat of the inclusion of the it grants for the uses of the water, parallel instrument to the charging. Finally, it will be devoted to the charging, trying to verify the compatibilization of the given juridical framing the water as an environmental right and as an economic right.
